The Smart Creator operates as a performance marketing agency providing bespoke advertising strategy, creative poster design, attribution configuration, and daily campaign management. All services involve immediate, dedicated allocation of senior marketing labor, creative designers, and ad account managers. This Refund Policy establishes the financial terms governing our retainer arrangements and direct media spend.

2. Management Retainer Fee Policy

Agency management retainers cover specialist labor committed in advance of each thirty-day billing cycle.

Retainer Terms:

Non-Refundable Delivery: Once a monthly billing cycle has commenced and campaign management, creative development, or media optimization work has begun, retainer fees for that cycle are strictly non-refundable.
Resource Commitment: Because agency team capacity is reserved exclusively for contracted clients, unspent portions of monthly management retainers cannot be rebated if a client elects to pause operations mid-cycle.
Pre-Commencement Cancellations: In the event a prospective client cancels an agreement prior to any onboarding audits or creative production having taken place, an administrative refund minus verified setup costs may be authorized at agency discretion.

3. Direct Third-Party Ad Spend Non-Refundability

A critical component of paid advertising is the separation between agency management retainers and direct media ad spend.

Media Spend Principles:

Direct Network Disbursement: Advertising spend is paid directly by the Client to advertising networks (Meta, Google, TikTok, YouTube) using Client billing credentials.
No Custody of Ad Funds: The Smart Creator does not hold, collect, or invoice media spend funds.
Zero Agency Refund Liability: The Agency cannot under any circumstance refund, rebate, or credit ad spend consumed on third-party advertising platforms.
Platform Inquiries: Any disputes regarding platform billing errors or ad credit disputes must be directed to the respective advertising network.

4. Agreement Cancellation and Notice Periods

We maintain a structured, equitable cancellation process for ongoing retainer agreements.

Cancellation Terms:

Standard Notice: Ongoing retainer contracts may be terminated by either party providing thirty (30) calendar days' written notice prior to the next billing date.
Delivery During Notice: The Agency continues full campaign management, creative delivery, and conversion tracking throughout the 30-day notice period.
Orderly Transition: Following completion of the notice cycle, the Agency provides full asset handover and disengages partner account access without penalty fees.

5. Administrative and Billing Discrepancy Corrections

The Smart Creator ensures complete transparency in all invoicing operations.

Billing Error Resolution:

Verifiable Administrative Errors: In the event of a verified administrative error (such as an inadvertent duplicate transaction or mathematical invoicing error), we will rectify the discrepancy promptly.
Notification Window: Clients must report suspected billing discrepancies within fourteen (14) calendar days of the transaction date.
Refund Processing: Approved administrative corrections will be returned to the original payment method within seven (7) to ten (10) business days.

6. Quality Commitment and Performance Alignment

While digital advertising performance cannot be guaranteed due to broader macroeconomic and competitive variables, client satisfaction remains our highest operational priority.

Alignment Procedures:

Performance Audits: If a campaign does not meet anticipated benchmark targets, our senior strategy team conducts an emergency performance audit within forty-eight (48) hours.
Creative Pivots: We will develop alternative creative variations, revised audience angles, and adjusted bidding strategies without additional creative fees.
Transparent Communication: Weekly reporting dashboards maintain clear visibility into every pound of ad spend and resulting conversion metrics.
